Elon Musk’s X has been fined nearly $1 million a day for allegedly violating a ban imposed on the platform.
The move marks a dramatic escalation of tensions between Musk’s social media platform X (formerly known as Twitter) and Brazil’s Supreme Court.
The ruling comes as part of an ongoing crackdown by Brazilian authorities on the spread of misinformation and hate speech. The court has accused Musk of attempting to evade the ban through technical maneuvers.
Court-Imposed Fines on X and Musk’s Alleged Defiance
On Thursday, Brazilian Supreme Court Justice Alexandre de Moraes ordered X to pay a daily fine of approximately $921,000 until the platform fully complies with the country’s ban.
The court accused the platform of enabling users to access X, despite the ban being in place for nearly three weeks. According to de Moraes, X’s switch to a different network provider allowed users to temporarily bypass the restrictions.
He said:
“There is no doubt that the X platform—under the direct command of Elon Musk—again intends to disrespect the Brazilian justice system.”
X’s Response and the Ban’s Origins
X has denied any intention to circumvent the ban. It claims the switch in network providers occurred after the company shut down its office and operations in Brazil.
In a statement, the social media company said that the platform’s accessibility in the country was an “inadvertent and temporary service restoration to Brazilian users.”
The Supreme Court originally imposed the ban on August 30. It cited X’s failure to block accounts spreading misinformation and hate speech, particularly in the context of Brazil’s political climate.
The platform also faced penalties for not paying $3 million in fines and failing to appoint a legal director in Brazil, a legal requirement under Brazilian law.
The crackdown comes as part of a broader effort by Brazil’s Supreme Court to regulate online content following the January 2023 attacks on government buildings in the capital by supporters of former President Jair Bolsonaro.
Many of those who stormed the buildings were motivated by false claims spread on social media. Many of the claims alleged Bolsonaro was the rightful winner of the 2022 presidential election.

Cloudflare’s dynamic IP addresses, which are shared by various organizations including Brazilian government agencies, complicate efforts to block the platform without disrupting other essential services.
Abrint, a trade group for Brazilian internet providers, stated that X’s use of Cloudflare’s services presented significant challenges. Blocking X’s new system could inadvertently affect major banks and government entities.
Anatel and Cloudflare are in discussions to find a solution. But it remains unclear how long it will take to fully enforce the ban. Anatel expressed optimism a mechanism could be found to ensure compliance with the Supreme Court’s order without disrupting other services in the country.
