Harley-Davidson In Clash With Next Over Trademark Infringement

Harley-Davidson is suing British clothing giant Next in London’s High Court over alleged trademark infringement.

The motorbike maker argues a “motorbike-inspired” t-shirt sold by Next blatantly copies its iconic trademark.

The disputed garment, a “Black Fearless Stud Graphic Long Sleeve T-Shirt” is for children aged three to 16.

The t-shirt has biker imagery commonly associated with Harley-Davidson brand, including flames, angel wings, and the slogan “Rise and Roar” across the chest.

Harley-Davidson said the product “essentially replicates” its logo’s outline.

It also says the “graphic material and text…is commonly seen in the context of a motorcycle-based branding and more specifically the claimants’ branding”.

“Black and flame and wing motifs are often used in combination with [Harley’s] branding and the trade marks.”

It added the design used by Next would “call [Harley’s imagery] to mind for many members of the public”.

Harley-Davidson requests a formal declaration from the court that Next has indeed infringed upon its trademark.  

The company is also pushing for a court order compelling Next to destroy “all infringing materials.”
