Hewlett Packard Enterprise (HPE) has confirmed its intention to continue a high court lawsuit against the estate of the late tech mogul Mike Lynch, who died in a yacht accident earlier this month.
The company is seeking damages of up to $4 billion (£3 billion). This decision comes despite Lynch’s recent death in a incident off the coast of Italy.
HPE said it will press to see the legal proceedings “through to their conclusion.” The US-based company previously won a civil fraud claim against Lynch in the English High Court in 2022. This was related to its $11 billion acquisition of Autonomy, a software company founded by Lynch, in 2011.
Background: The Autonomy Deal and Legal Battles
- Civil Fraud Case: HP accused Lynch and his former finance director, Sushovan Hussain, of inflating the value of Autonomy before the 2011 acquisition.
- 2022 Court Ruling: The English High Court found in favor of HP. Mr. Justice Hildyard rules HPE had “substantially succeeded” in its fraud claims against Lynch and Hussain.
- Pending Damages Ruling: While HPE is seeking up to $4 billion, Justice Hildyard indicated that the final damages awarded would likely be “substantially less” than the amount claimed.

Lynch’s Death and Its Impact on the Case
Lynch, 59, who had been acquitted in a separate US criminal fraud trial related to the Autonomy deal, died last month when his superyacht, Bayesian, sank near Sicily. His 18-year-old daughter, Hannah, also died in the accident, while his widow, Angela Bacares, was among the 15 survivors.
Before his death, Lynch had slammed the US justice system, saying he was only acquitted because he had the wealth to continue to fight to clear his name,
HPE Statement
“In 2022, an English high court judge ruled that HPE had substantially succeeded in its civil fraud claims against Dr Lynch and Mr Hussain. A damages hearing was held in February 2024 and the judge’s decision regarding damages due to HPE will arrive in due course. It is HPE’s intention to follow the proceedings through to their conclusion.”
Next Steps for HPE and Lynch’s Estate
- Awaiting Damages Ruling: The court’s decision on the damages due to HPE is expected soon.
- Family’s Response: Lynch’s family has declined to comment on the ongoing legal proceedings.
- Public Reaction: The case will likely continue to draw public and media scrutiny, especially given the high-profile nature of the individuals involved and the significant sums at stake.
Navigating the Legal Landscape
HPE’s decision to pursue this claim illustrates the complex intersection of legal responsibility, corporate governance, and public perception. As the case progresses, the outcome will not only determine financial liabilities but also potentially influence how similar cases are handled in the future.
