Dimerco Express faces $3M payout in racial discrimination lawsuit

A federal jury has ruled logistics company Dimerco Express USA must pay over $3 million over racial discrimination in hiring.

This case, known as Faulk v. Dimerco Express USA Corp, originated from a complaint filed in 2021. 

The complaint says the plaintiff had applied for an account executive position with Dimerco in 2019 and initially received a job offer.

However, the firm later withdrew the offer, citing a misdemeanor disorderly conduct charge that the plaintiff had incurred in 2014.

However, the firm then hired a white candidate with a more significant criminal record. 

The plaintiff alleged a Dimerco HR director told him the company “only wanted to hire whites.”

It was also claimed the HR director told him “whites could get in the door with customers that minorities could not.”

The verdict includes compensation for lost wages, emotional distress, and punitive damages.

The plaintiff’s legal representation, Barrett & Farahany, presented evidence during the trial.

Alleged “race-matching” policy

It suggested that Dimerco had a policy of “race-matching.”

It involved hiring only Caucasian people to cater to what the company referred to as the “Caucasian market.” 

This evidence included internal emails indicating Dimerco intended to exclusively hire White individuals aged 26 to 40 for sales executive roles

Furthermore, it was revealed that the company’s president had vetoed the plaintiff’s hiring upon discovering he was Black.

Dimerco has not provided immediate comments regarding the jury’s decision. 

The breakdown of the awarded amount includes $90,000 for lost wages and benefits and $150,000 for past emotional distress and mental anguish.

An additional $150,000 is allocated for future emotional distress and mental anguish and $3 million in punitive damages.
