Elon Musk’s X Cleared to Resume Service in Brazil

Brazil’s Supreme Court has cleared the social media platform X, formerly known as Twitter, to resume operations after it complied with local court orders.

The decision marks the end of a months-long standoff between Elon Musk, owner of X, and Brazilian Supreme Court Justice Alexandre de Moraes.

The dispute had led to the platform’s suspension in late August, with Brazilian authorities citing non-compliance with hate speech moderation requirements and a lack of local legal representation.

X Reinstated After Compliance

In his ruling, Justice Alexandre de Moraes confirmed that X had met all necessary conditions to resume operations in Brazil.

This includes implementing stricter content moderation policies to limit hate speech and appointing a legal representative in the country.

The decision requires Brazil’s telecommunications regulator, Anatel, to reinstate the platform within 24 hours.

Through its Global Affairs account, X expressed gratitude for the opportunity to return to one of its largest markets, saying, “We will continue to defend freedom of speech, within the boundaries of the law, in the countries where we operate.”

From Defiance to Compliance

The confrontation between Musk and Brazilian authorities began when X initially refused to comply with Brazilian court orders, describing them as “illegal.”

Musk accused Justice Moraes of censorship and referred to him as a “dictator.”

However, over the past several weeks, Musk changed his stance, and X began to comply with the orders by blocking flagged accounts, appointing a local representative, and paying outstanding fines.

In response, Justice Moraes stated that Musk’s compliance demonstrates the necessity of respecting local laws. Brazil’s Communications Minister Juscelino Filho praised the outcome as a “victory for the country,” adding, “We showed the world that here our laws should be respected, by whomever it may be.”

A Significant Market for X

Brazil is X’s sixth-largest market globally, with approximately 21.5 million users as of April, according to Statista.

During the suspension, Brazilian users migrated to rival platforms such as Bluesky and Meta’s Threads, underscoring the competitive landscape X faces upon re-entering the market.

Despite initial opposition, Musk and X took several steps in recent weeks to align with Brazil’s regulations.

In late September, X appointed Rachel de Oliveira Conceicao as its local legal representative and began blocking accounts flagged by Brazilian authorities. Additionally, X paid pending fines to open the door for reinstatement.

Musk’s Global Free Speech Stance

The battle in Brazil is one of several confrontations Musk has faced with governments worldwide over his stance on free speech.

Recently, X has been in the spotlight in countries like Australia and the United Kingdom, where local authorities are cracking down on online misinformation.

In Brazil, Justice Moraes has led efforts to counter disinformation, particularly regarding political and democratic processes.

President Luiz Inacio Lula da Silva publicly supported the platform’s suspension, emphasizing that any business operating in Brazil must respect the country’s laws.

He stated that Brazil is not obligated to “put up with Musk’s far-right ideology just because he is rich.” Moraes’s ruling also garnered support from the Brazilian Supreme Court, underscoring the country’s commitment to enforcing local laws on all companies.

Now that X has met Brazil’s requirements, it faces the challenge of re-establishing its presence in the country.

Many users have migrated to alternative platforms, and X must work to regain their trust and rebuild its user base.
