Tesla wins legal battle over alleged retaliation firings

A US labor board has thrown out claims Tesla unlawfully dismissed Autopilot software workers who engaged in union activities.

The Workers United accused the company of firing dozens of Autopilot department employees at its Buffalo, New York "gigafactory." 

The union claims the incident happened shortly after announcing a union campaign earlier this year.

Tesla maintained the terminations were performance-related and unrelated to union involvement. 

While the labor board dismissed the complaint, it did recognize the legitimacy of two distinct claims. 

These involve Tesla's purportedly unlawful workplace technology usage rule and the alleged illegal solicitation of employee grievances in response to union organizing efforts.

Kayla Blado, National Labor Relations Board spokesperson said if Tesla fails to settle these claims, the NLRB will issue a formal complaint against the company.

The body said it’d be adjudicated by an administrative judge. 

Tesla and Workers United did not immediately respond to requests for comment.
