Purpose of Position:

Under general supervision of the Director of Labor Relations, participates in the administration of Labor Relations programs of the Health and Hospitals Corporation, including contract negotiations and interpretation, investigation and processing of employee grievances and hospital discipline. Conducts hearings at the Corporate level, participates in arbitration appeals and maintains liaison with employee union representatives and personnel labor relations administrators of local hospitals. Performs related work in public employee labor relations in conduct of union-management activities.

Examples of Typical Tasks:

  • Participates in collective bargaining discussions through direct negotiations with unions on noneconomic demands and, in cooperation with New York City Office of Labor Relations, on matters of an economic nature.
  • Prepares progress reports, develops summaries and reports status of negotiations, including trends, likeliness of impasses and resolution of collective bargaining matters. Assists in preparation of Corporation’s position before fact-finding impasse panels.
  • Prepares analysis of impact of union demands on hospital operations and prepares rebuttals and strategies to deal with such, including recommendations for management’s counter demands prior to and during negotiations

  • Discusses local hospital issues and their resolution with personnel-labor relations management staff. Maintains routine contact with hospital representatives.
  • Maintains liaison with Office of Labor Relations, Office of Collective Bargaining and other City, State or Federal agencies relating to various labor relations matters.

Minimum Qualifications


1. 2. A combination of training and experience, which is equivalent to “1” above. Higher-level of education may be substituted for one (1) year of experience, however only education above a Bachelor’s level can be counted towards substitution for experience. Reporting to and working with the Vice President, Employee Experience and Engagement (Human Resources), the Labor Relations Director at ArtCenter College of Design will work with the VP to lead, facilitate and manage the College's labor relations program. Working with labor counsel, the incumbent will serve as the College's chief negotiator, will guide all bargaining strategies with the understanding that positive experiences and engagements of our students, faculty and staff are a priority for the College, while maintaining the financial viability of the College and the high standard of education that it's known for.

The incumbent will listen, learn and understand the needs of the College community and the guiding principles that drive our organizational culture to lead the day-to-day administration, execution and interpretation of the collective bargaining agreement, MOUs, side letters, including compliance and effective project management of union contract negotiations, effects bargaining, information requests, grievance procedures, and dispute resolution.

This is a full-time in-region position. Normal business hours are Monday through Friday, 8:30 a.m. to 4:30 p.m. The position requires flexibility to meet the demands of the work, which could include weekends or evenings. However, it is expected that the incumbent perform work in the office at least three days out of the workweek.

Essential Functions

Labor Administration 60%

  • Timely respond to information requests for bargaining, hearings, NLRB lawsuits, mediations, arbitrations or other matters that require the College to respond to said requests; assess what information is required under the law and within the union contract; as required, participate in said proceedings
  • Maintain a labor activity portal to track all labor activities
  • Lead the ACFF-ACCD Committee meetings to facilitate proactive and positive labor relations with the union; prepare objectives and agendas
  • As a subject matter expert on labor relations, counsel and guide leadership, department heads, managers and supervisors on delicate and sensitive matters pertaining to union issues
  • With a strong command and knowledge of the collective bargaining agreement, provide ongoing interpretation, including holding learning sessions with academic and operational leadership for compliance with and administration of the collective bargaining agreement
  • In partnership with Marketing and Communications (as necessary), communicate ongoing messaging about bargaining status and other labor relations issues
  • As the primary liaison for the union, establish and cultivate professional, productive, collaborative and collegial relationships with internal and external union representatives
  • Oversee the grievance process to ensure compliance and facilitate any solutions before they lead to mediation or arbitration
  • Comply with federal and state labor and employment laws, including the NLRB and the NLRA for all bargaining activities; consult with legal as needed
  • Provide bargaining updates to the Board of Trustees, as requested

Contract Bargaining Administration 30%

  • Serve as chief negotiator for the College, including new contracts, effects bargaining, Memorandum of Understanding (MOUs), successor agreements, side agreements, settlement agreements and meet and confers; consult with legal counsel and the VP as needed for strategic direction
  • Work directly with the union's chief negotiator(s) for bargaining schedules and processes
  • Collaborate with the union's chief negotiator(s) to identify issues and possible responses associated with bargaining - both in advance of negotiations for strategic planning and during negotiations as new issues arise
  • Meet with College administrators to define bargaining goals and principles, understand cultural impacts, and develop approaches and strategies for negotiations
  • Hold listening sessions to collect, aggregate and analyze data from various departments and operational units to assess current business practices and the cost impact of potential bargaining initiatives
  • Use information learned in information sessions and data gathering to draft proposals for negotiations; receive and assess feedback; track all revisions; record tentative agreements
  • Lead contract negotiating team (CNT) members during regularly scheduled team meetings from strategies to table negotiations; consult with subject matter experts on various bargaining topics to assess impacts during bargaining
  • Hear and investigate all union claims of potential unfair labor practice (ULP) charges or claims that require effects bargaining or a meet and confer; gather and coordinate information requests from relevant departments and operational units to form the College's defense and to assess the merits of the claims under the collective bargaining agreement; prepare responses with clear and concise recitation of the facts, applicable law or contract provisions, appropriate analysis, and recommendations for courses of action
  • Organize and document all steps of the bargaining process up to and including contract ratification or impasse protocols

Responsibilities

Core Responsibilities
  • In a fast-paced work environment, manage a high volume of inquiries seeking advice and counsel concerning fact-finding investigations, the grievance procedure, discipline, the duty to bargain and other legal requirements under the National Labor Relations Act and the interpretation of the various collective bargaining contracts.
  • Establish and maintain relationships with management representatives and union leadership and partner with both groups to facilitate the resolution of labor issues.
  • Represent the company in labor arbitrations concerning discipline and matters of contract interpretation. Preparation for the arbitration proceeding to include investigating the facts to develop the case, conducting in-depth legal research and reviewing arbitration precedence to develop the theory of the case and writing post hearing briefs.
  • Participate in collective bargaining.
  • Present to executive leadership on notable arbitration decisions and HR Labor Relations initiatives.
  • Draft labor relations updates and correspondence for company-wide distribution.
  • Facilitate skills-based labor relations training for all management employees.
  • Serve as company advocate in NYS Unemployment Insurance hearings, as needed.
  • Perform other related tasks and assignments as required.
Qualifications

Required Education/Experience
  • Bachelor's Degree and 5-7 years of experience and
  • Juris Doctorate

Relevant Work Experience
  • 5-7 years Full time labor relations experience at a large, unionized employer or large union which must including arbitration experience as advocate. Other litigation experience may be an acceptable substitute. Required

The County of Santa Clara is seeking an experienced Labor Relations Representative (Classification: Labor Relations Representative). This position will perform professional level labor relations duties including contract negotiations and administration, grievance handling, guiding departments on disciplinary actions, dispute resolution, training and research, and advising County departments on employee performance management. The ideal candidate will have an extensive background in California public sector labor negotiations, preferably including substantial experience representing management interests. They will have a strong understanding of the techniques of public sector collective bargaining under the Meyers-Milias-Brown Act (MMBA), as well as knowledge of the Americans with Disabilities Act (ADA), Equal Opportunity Employer (EEO) status, the Family Medical Leave Act (FMLA), and the Fair Labor Standards Act (FLSA). Successful candidates will have a demonstrated ability to work collaboratively across a large organization and a proven ability to build and sustain collaborative and effective relationships with labor organizations.

  • Serves as the chair or a member of a negotiating committee;
  • Develops negotiating proposals;
  • Researches, analyzes and costs union and County proposals;
  • Bargains within established limits;
  • Writes labor contract language;
  • Implements or assists in the implementation of negotiated labor agreements and arbitration awards;
  • Serves as a subject matter expert in meetings with the Board of Supervisors, department/agency heads and other County staff;

  • Prepares and presents, or assists in the presentation, of cases in mediation and/or arbitration;
  • Prepares and presents, or assists in the presentation, of discipline appeal cases to the Personnel Board or hearing officer;
  • Develops and maintains communications with labor organization representatives;
  • Develops and implements training programs on labor relations topics;
  • Oversees county staff as required by assignments; e.g., serving as negotiating committee chair and implementing agreements;
  • May supervise subordinate professional and clerical staff;
  • May be assigned as a Disaster Service Worker as required;
  • Performs other related duties as required.

Sufficient education, training, and experience, to demonstrate the possession and direct application of the following knowledge, skills and abilities.

Training and Experience Note: The knowledge and abilities required to perform this function are acquired through training and experience equivalent to a Bachelor's Degree from an accredited college or university, AND Three (3) years of professional level analytical experience of which one (1) year is in the field of labor relations or human resources. Qualifying labor relations or human resources experience includes experience serving as a member of negotiating committees; developing negotiating proposals; researching, analyzing and costing proposals; writing of labor agreements/contract language; and/or conducting meet and confers. Experience in the public sector is desirable.

Possession of a valid California Driver's License prior to appointment and the ability to qualify for and maintain a County driver authorization.
