Primary Duties

The successful Lead Attorney will have a deep expertise in employment discrimination law and is a fearless negotiator, a master of persuasive storytelling, and a strategic thinker who thrives in high-stakes, fast-paced environments. You must be a true team leader who can energize a team to work as a unit to maximize case value. This role is ideal for an attorney who has a strong track record of settling cases—particularly in the pre-litigation phase—and who knows how to lead with both legal insight and operational savvy to extract the highest level of performance from the overall team. The expectation is that pre-litigation settlements will yield at least one million dollars annually. Additional duties include the following:

  • Serve as the strategic lead on all employment discrimination matters, particularly during the pre-litigation phase
  • Manage a team composed of:
    • A Junior Attorney (drafting legal motions, responses to demand letters as well as researching legal issues, jury demands, conducting investigations and executing any additional tasks necessary to maximize case value and assist in moving case efficiently.

  • Engage directly with opposing counsel and agencies (EEOC, DFEH, etc.)

Requirements

  • J.D. from an accredited law school; licensed and in good standing with New York State Bar

**The Opportunity**
The **Diversity and Access Offic** e is responsible for university-wide compliance with federal, state, and local regulations concerning disability access and non-discrimination for which other offices are not responsible. The **Disability Affairs and Non-discrimination Compliance Associate** (Associate), in coordination and collaboration with the Director, Diversity and Access, will play an instrumental role implementing the office's compliance obligations related to ADA, non-discrimination, and federal affirmative action legal requirements in alignment with the University's mission.
Reporting to the Director of the Diversity and Access Office, the Associate in collaboration with the Director and the Office of the General Counsel, serves as the Americans with Disabilities Act (ADA) Program Coordinator by advising schools and units regarding matters concerning compliance of sections 503 and 504 of the Rehabilitation Act of 1973 (Sections 503 and 504). The Associate will also assist in ensuring Stanford's compliance with the Equal Pay Act, the ADA, the Age Discrimination and Employment Act, Executive Orders, FEHA, and the UNRUH Civil Rights Act, among other laws.

+ Develop training and provide technical advice for university stakeholders regarding ADA compliance

This position is located at Central Office in St. Paul and may have the flexibility to work a hybrid schedule, or work in the office. The incumbent will be required to make a telework arrangement with their supervisor. The incumbent will be expected to work in the office as determined by policy and discussion with their supervisor.
This position ensures legal and policy compliance with the department's obligation to provide timely and effective responses to both internal and external complaints of workplace discrimination, reprisal and discriminatory harassment by conducting complex investigations, handling complex matters, including overlap with FMLA, Worker's Compensation law, contractual bargaining rights, and undue hardships. This position is also responsible for writing and reviewing workforce policies and ensuring adherence to current case law, regulatory guidance and statutory requirements under various state and federal laws including: Title VII of the Civil Rights Act, the Equal Pay Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Minnesota Human Rights Act, State Personnel Management, Minn. Stat. Chapter 43A, the Minnesota Government Data Practices Act, Minn. Stat. Chapter 13, FHWA Civil Rights laws, relevant rules of Civil Procedure, and all related MnDOT internal policies.
The incumbent serves as MnDOT's primary contact for discrimination-related matters and confers regularly with the Minnesota Attorney General's Office and Minnesota Management and Budget regarding internally and externally filed complaints of discrimination, as well as lawsuits filed in state and federal court. Additionally, the position provides legal counsel to managers and Human Resources and manages key aspects of the department's statewide internal complaint process, including recommending informal resolution methods (e.g., mediation) referring cases; determining investigative strategies and processes; hiring and directing contractors to conduct expert discrimination investigations; drafting comprehensive investigative reports; and making findings and recommendations for appropriate follow-up.
**The Minnesota Department of Transportation does not sponsor applicants for work visas or Optional Practical Training Extensions for STEM students. Individuals must be legally authorized to work in the US at the start of employment.
**Minimum Qualifications**
Three years of advanced professional experience applying state and federal non-discrimination law that demonstrates the following:
+ **Performing complex legal and case analysis**
+ **Conducting all aspects of complaint investigations,** including drafting investigative reports and findings, and providing follow-up guidance to management
+ **Responding to discrimination complaints**
**NOTE:** A Juris Doctor degree from an American Bar Association accredited law school substitutes for one year of advanced professional experience.
**Preferred Qualifications**
+ A Juris Doctor degree.
+ An active license to practice law in Minnesota.
+ Experience working in the public sector.
