About this JobThe Division of Administration/Office of Risk Management has a vacancy. This job title has an assigned pay grade of AS-624.
The Office of Risk Management administers the state's risk management program and self-insurance fund. ORM is solely responsible for managing all state insurance coverage, both purchased and self-insured, for workers' compensation, property, and casualty exposures. ORM is also responsible for managing all tort claims made against the state or any of its agencies, whether or not they are covered by the self-insurance fund.
At the designation of the Commissioner of Administration, ORM also serves as the State of Louisiana public facilities sub-recipient representative for Federal Emergency Management Agency (FEMA) Public Assistance Grants under Subpart G, Title 44 Code of Federal Regulations.
ORM contracts with a third party administrator to provide claims adjusting and loss prevention services, however ORM retains its authority to authorize and approve all claims negotiations and settlements.
ORM consults with its insured agencies on safety and loss control; provides for elevator inspections, jurisdictional boiler inspections, and testing of electrical equipment at state facilities; reviews agency contracts for insurance and indemnity clauses; issues certificates of insurance; and maintains valuations of state-owned property.
The Division of Administration is the state government's management arm and the hub of its financial operations. Division offices perform a wide variety of activities including the following:
- Overseeing the state's capital construction program
- Working to provide state and federal grants for community development
- Development of the state budget
- Providing technology services
- Giving agencies guidance in the state purchasing and contracting process as they seek goods and services
- Administering a program that provides federal funds to help Louisiana residents recover from a series of devastating hurricanes

Job Duties and Other InformationJob Duties:
Direction, supervision, and monitoring of the litigation unit staff:
1) Determines, reviews, and approves work assignments to litigation unit staff;
2) Conducts staff meetings to discuss operational issues and status of lawsuits and other projects;
3) Monitors staff progress, evaluates results, and documents performance;
4) Identifies staff development needs and assures training is accomplished;
5) Reviews recommendations and approves process changes to achieve greater productivity and efficiency within the unit;
6) Provides guidance and assistance in resolving complex problems and issues;
7) Performs CPM performance planning and review sessions;
8) Conducts interviews for vacant positions as needed and provides hiring recommendations to State Risk Director.
Management, oversight, and administration of all tort litigation and litigation management activities:
Counsels and assists the State Risk Director, Assistant Director, administrators, managers and staff regarding litigated claims involving various state agencies under the risk management program utilizing a working knowledge of all phases/disciplines of tort litigation. This includes general liability, maritime, workers' compensation, road hazards, civil rights, transportation and medical malpractice claims. Oversees the direction and outcome of approx. 3,000 litigated claims annually, including the responsiveness and effectiveness of 200+ assigned defense counsel.
Serves as the primary liaison with the Department of Justice Litigation Division (DOJ) and private contract counsel on behalf of ORM. Discusses and coordinates with DOJ on the appointment of private contract counsel; evaluates and makes recommendations on the transmittals seeking ORM concurrence on attorney appointments prior to execution by the State Risk Director. Identifies and reviews existing and potential conflicts of interest of assigned counsel, and seeks consensus with DOJ on acceptable conflict waivers. Reviews and seeks consensus with DOJ on all removals of cases to federal court or remanding of cases from federal to state court. Reviews and seeks consensus with DOJ on stipulations of liability, waiver of jury trials, bifurcations of trial, and proceedings before a federal magistrate.
Directs and collaborates with ORM staff on the annual review and update of the ORM-DOJ Interagency Agreement and its supporting documents. Reviews and advises on issues concerning billing for legal services by both private contract counsel and DOJ.
Reviews and evaluates petitions and complaints for coverage provided through the ORM coverage documents (defense and/or indemnity). Coordinates and seeks consensus with DOJ on these issues.
Reviews, analyzes and evaluates all Requests for Settlement Authority (RSA) with a requested monetary amount of 200,000 or more. Upon request by the claims supervisor, manager, or administrator, reviews and advises on any other RSA that may involve legal issues or implications in which direction is sought.
Leads and directs ORM claims council, case staffing meetings, and strategy team meetings, which may include representatives from DOJ, private contract counsel, ORM's third party administrator, and the insured agency, as needed, with the goals of providing a 360? analysis of the possible case outcomes and securing a consensus on strategy to provide the best resolution.
Attends and monitors trials, mediations, and appellate/other hearings as needed or required.
Drafts and/or coordinates the creation of forms, proposals, policies, and language, as needed, to be used by various parties in state tort litigation. This includes certain form pleadings, modifications to coverage documents, and proposed legislation.
Provides tort law and litigation process training as needed for ORM staff, the TPA, and private contract counsel.
Communicates and collaborates with DOA Office of General Counsel staff as needed to inform, update, and work in partnership to achieve the highest and best outcomes regarding litigated claims and other legal matters.
ORM internal chief legal counsel responsibilities:
Serves as internal legal counsel to ORM providing legal advice to the State Risk Director and staff. Drafts and/or coordinates the preparation of written correspondence and legal documents on behalf of the State Risk Director or the other State Risk Assistant Director as required.
Directs and coordinates the tracking and monitoring of legislation affecting the mission of ORM. Collaborates with staff to prepare legislative impact statements and fiscal notes. Identifies circumstances where legislation could promote a more effective risk management program and coordinates the drafting of legislation for consideration by the Commissioner of Administration. Attends legislative committee hearings and testifies on legislation as needed.
Regularly appears before the Litigation Subcommittee of the JLCB when it considers payment of certain settlements.
Acts as primary liaison between ORM and State agency general counsel representatives. Responds to inquiries from insured agencies and solicits assistance from same within the context of litigation, as needed.
Assists ORM staff in the interpretation, explanation, and implementation of federal and state statutes, jurisprudence, ORM rules, coverage documents, and claims processing procedures. Communicates those interpretations to insured agencies and outside parties as needed.
Meets with high-level state officials and agency staff, such as Department Secretaries, Undersecretaries, Agency Directors, Legislative Fiscal Office staff, and Legislators, to provide information and resolve issues. Prepares high level technical information and is prepared to present to large groups of people as required.
Special projects:
Performs or directs the performance of special projects as assigned. This could include preparation of complex specialized reports, reviewing and preparing correspondence on sensitive matters, participating in or leading workgroups regarding multi-dimensional office functions outside of the litigation unit, etc.
Serves as the State Risk Director's representative in his/her absence. Acts as a representative of the office in any matter as directed by the State Risk Director.
May travel to any part of the State or elsewhere to attend meetings or events, provide support or training, resolve issues, and complete other duties and responsibilities of the office.

The attorney will also be responsible for advising ADOT in regard to procurement and other contract issues. We have an exciting opportunity for a **Senior Manager, Supply Chain (SC) Legal Advisor** , who will report to the Associate Director, Raytheon SC Advising. The SC Advisor provides advice and drafting support for purchasing professionals and will: review purchase order/subcontract terms and conditions in compliance with applicable company policies and procedures, internal guidance briefs, federal, state, and local laws, as well as the Federal Acquisition Regulation (FAR) and supplements thereto. **Note that** **this role is an advisory position, working** **_with_** **Counsel to resolve legally related issues supporting our Procurement and Program teams. It is** **not** **a General Counsel or an Attorney position and will not represent Raytheon in any legal capacity.**
Additionally, this role will advise purchasing professionals and program managers on subcontract issues such as warranty interpretation, limitation of liability, termination for convenience or default, indemnification, and other subcontract terms and risks, as well as novations/assignments, software licensing for Commercial and Free and Open Source Software, intellectual property issues, teaming agreements and other collaborative agreements, proprietary information agreements, and other agreement types.
**What You Will Do:**
+ Draft terms & conditions, software licenses, and other agreements that provide the best protection and benefit to the company.
+ Research legal issues for the Supply Chain organization or the Legal, Contracts, and Compliance (LCC) office.
+ Assist in establishing negotiation goals, and assist in negotiations regarding deviations from standard provisions.
+ Review and advise SC on performance issues such as claims and insolvency.
+ Assist the organization in writing business processes, policies and in oversight reviews.
+ Provide training and communications.
+ Assist in maintaining standard terms & conditions and negotiations guidance.
+ Review complex legal issues with Counsel as appropriate and support audit activities.
+ Maintain active communication with requesters, management, Subject Matter Experts (SMEs), and SC and Program Counsel on significant legal problems and issues.
+ Minimal domestic travel to Raytheon sites as required.
**Qualifications You Must Have:**
+ Typically requires a University Degree or equivalent experience and minimum 10 years prior relevant experience, or an Advanced Degree in a related field (i.e. Juris Doctorate or Masters Degree in Legal Studies preferred) and minimum 7 years' experience
+ Experience with US Government (FAR / DFAR Supplements and Government contract procurement processes), licenses, and / or commercial contracts drafting and negotiations
**Qualifications We Prefer:**
+ Experience with Supply Chain processes and procedures
+ Legal research experience
+ Experience with export/import, cybersecurity, and privacy law and issues
+ Strong collaboration, as this candidate will have regular interaction with Supply Chain personnel, LCC and Program Counsel, other SME functions, and other business entities
+ Detail oriented, excellent problem-solving skills, and ability to develop options and solutions that are practical and can be readily acted upon
+ A positive, cooperative attitude, but assertive when necessary to comply with company policies and Government regulations and laws
+ Ability to work effectively in a fast-paced work environment, with often changing goals and requirements, and a very heavy workload, including special projects
+ Active and transferrable DoD Secret security clearance with ability to obtain a (TS/SCI)

The salary range for this role is 124,000 USD - 250,000 USD. The salary range provided is a good faith estimate representative of all experience levels.
