Job Description

The New York City Department of Correction (DOC) is an integral part of the City’s evolving criminal justice system, participating in reform initiatives and strategies aimed to move the City towards a smaller jail system without compromising public safety. The DOC is responsible for maintaining a safe and secure environment for our employees, visitors, volunteers, and people in our custody. Importantly, safe jails enable DOC to provide people in custody with the tools and opportunities they need to successfully re-enter their communities. The DOC operates facilities and court commands across the five boroughs with more than 7,500 diverse professionals and knowledgeable experts.

The DOC seeks to recruit a Labor Relations Attorney to represent the agency and assist in the administration of collective bargaining agreements and labor contracts covering employees in over one hundred civil service titles. Under direction of the Executive Director of Labor Relations and with the latitude to exercise independent judgment, the incumbent will:

  • Provide advice to the agency's uniformed and non-uniformed managers.

  • Interpret labor contracts, rules and regulations and attend meetings.

  • Serve as a liaison between the department and various labor unions.

  • Conduct Step two conferences on grievances and disciplinary matters of

non-uniformed employees.

  • Evaluate disciplinary matters for legal sufficiency.

  • Draft charges at third-step grievance hearings and trials at the Office of

Administrative Trials and Hearings.

  • Investigate and research labor related matters, grievances and related

issues.

  • Respond to union grievances including health and safety matters.

  • Handle workplace violence issues and meetings.

  • Act as liaison with the Office of Labor Relations regarding collective

bargaining and labor relations matters.

  • Handle accretion petitions, arbitrations and hearings at the Office of

Collective Bargaining.

  • Consult with the General Counsel, where appropriate concerning the legal

framework of negotiation strategies.

  • Collaborate with the Corporation Counsel and the Department's General

Counsel; on litigation matters.

  • Represent the unit in orientation and training sessions of agency staff.

  • Perform other related duties as required.

Preferred Skills

  • Professional experience in Labor Relations & collective bargaining

negotiations.

  • Experience in trials/administrative hearings.

  • Knowledge of citywide policies and procedures issued by the Department of

Citywide Administrative Services.

  • Knowledge of Labor Relations including the Collective Bargaining

Agreements.

  • Ability to work independently; establish and maintain working relationships.

  • Interpret complex rules, contracts, arbitration awards and other official

mandates.

  • Proficiency in Microsoft Office, Excel and PowerPoint.

Qualifications

  1. Admission to the New York State Bar; and either "2" or "3" below.

  2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or

  3. Six months of satisfactory service as an Agency Attorney Interne (30086).

Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.

In addition to meeting the minimum Qualification Requirements:

To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

  • In a fast-paced work environment, manage a high volume of inquiries seeking advice and counsel concerning fact-finding investigations, the grievance procedure, discipline, the duty to bargain and other legal requirements under the National Labor Relations Act and the interpretation of the various collective bargaining contracts.
  • Establish and maintain relationships with management representatives and union leadership and partner with both groups to facilitate the resolution of labor issues.
  • Represent the company in labor arbitrations concerning discipline and matters of contract interpretation. Preparation for the arbitration proceeding to include investigating the facts to develop the case, conducting in-depth legal research and reviewing arbitration precedence to develop the theory of the case and writing post hearing briefs.
  • Participate in collective bargaining.
  • Present to executive leadership on notable arbitration decisions and HR Labor Relations initiatives.
  • Draft labor relations updates and correspondence for company-wide distribution.
  • Facilitate skills-based labor relations training for all management employees.
  • Serve as company advocate in NYS Unemployment Insurance hearings, as needed.
  • Perform other related tasks and assignments as required.

General Purpose

This Director level attorney position will work on the Ross Legal team as a member of the Employment Law team primarily assessing, handling, and managing employment claims including defending Ross in agency hearings and in arbitrations. This position will collaborate with and support team members in Legal to execute job requirements and to provide effective internal communications and reporting. This position will potentially also work with other groups within Legal, business stakeholders, and HR to promote compliance and mitigate legal risk.

This attorney will work collaboratively and responsively with a broad range of colleagues, facilitating a coordinated team approach to providing employment law legal services including: primarily working on optimal litigation results (agency, individual, and representative actions) with the potential for future work on employment law training/skills development, projects, and advice and counsel on employment issues (such as employee discipline, policies, leaves and accommodations, investigations, separation agreements).

The position will report to the GVP, Employment Law and will work directly with and support other employment law team members on the handling of claims and other tasks as assigned.

The base salary range for this role is $70,000 to 220,000. The base salary range is dependent on factors including, but not limited to, experience, skills, qualifications, relevant education, certifications, seniority, and location. The range listed is just one component of the total compensation package for employees. Other rewards vary by position and location.

Essential Functions

  • Claims management: Deliver effective, business-focused agency charge, attorney demand and litigation results efficiently, performing work directly or appropriately leveraging and managing outside counsel.
  • Day to day employment law advice: Provide practical and business-focused employment law advice and counsel, considering multiple stakeholder perspectives where necessary. Assess risks and offer client-focused practical solutions and options.
  • Proactive compliance: Partner with Legal, HR and other stakeholders to develop, implement, and monitor policies and practices to promote compliance and mitigate legal exposure. Maintain constructive relationships with clients, stakeholders and peers and work collaboratively to identify and assess options for resolving compliance issues.
  • Reporting and continuous learning: Partner effectively/collaborate with team members to ensure adequate reporting on litigation outcomes and learnings, internal/external trends, legal updates and projects updates, and to develop a/or deliver effective employment law training.
  • Ross Legal team: Collaborate and build positive, productive relationships with team members at all levels across Legal.

Qualifications And Special Skills Required

  • California JD with 5+ years of employment law litigation experience (or equivalent)
  • Extensive, successful experience directly handling a variety of employment law claims and litigation in California including claims related to discrimination, harassment and disabilities/ADA/Leaves/Title VII
  • Flexible team player with strong interpersonal and relationship skills; able to build strong relationships with diverse array of internal and external stakeholders
  • Strong business sense with excellent legal acumen, analytical, drafting and negotiation skills
  • Exceptional organizational and project management skills with attention to detail
  • Experience managing a large volume of work in a fast-paced environment, while following through and meeting deadlines
  • Excellent oral/written communication skills including ability to communicate in plain language and ability to learn and emulate norms for internal updates
  • Collaborative and helpful - as concerned about team members as they are themselves

Physical Requirements/Ada

This position requires the ability to work in an office environment, including using a computer, attending meetings, working as part of a team, and the ability to communicate with team members and others. Regular attendance also is a requirement of the position.

This role requires regular in-office presence, including attending in-person team interaction, meetings and collaboration, client support, mentoring, coaching, and/or feedback. However, this role can perform duties effectively using a combination of in-office and remote work.

Supervisory Responsibilities

While this position may not have direct reports, as an attorney with responsibility for managing claims and projects, there is responsibility to effectively delegate to and develop employment law legal professionals.
